My aunt signed and dated her typewritten will (with two witnesses present) before she passed away. She was a US citizen, but some of the property stated in the will is in the Philippines. My mom (a dual citizen of the US & Philippines) is supposed to inherit nearly everything (according to my aunt’s request in the will), but now my mom’s siblings are saying, “No, you need to prove the signature in the will is real before we let you have everything. If not, the property should be divided amongst us all.”

1) How do you prove a will is legal when the person has already passed?
2) Why does my mom even have to prove it’s valid? Shouldn’t they prove it’s invalid?
3) Will the US Embassy help my mom since my aunt was a US citizen and the people (my uncle and aunts) who are making it difficult are non-US citizens? Doesn’t the US Embassy protect and help all US Citizens (living or deceased)?

Any advice would be greatly appreciated.

My husband had a friend see if his father had left a will in the state where they had lived. We don’t live there anymore. There was a will on file with a filing number. In addition to the will there was something else filed specifically for my husband with it’s own filing number. My husband can’t remember what it was called and we can’t get in touch with our friend. He said it sounds like it starts with “sect…” but he can’t remember for sure. It is not section, or succession. Does anyone know what this might be?
It’s not executor, we know all about that what an executor is. Thank you for the help, though. I’m starting to think it is succession, and that he just does not know. The will is in Louisiana, and I see from Googling that the term “succession” is common there. Any more ideas are still appreciated.

Please re-word the above part so it sounds more smooth and flow-y, along with it making more sense….?? also…does this make sense??? The person who receives it will get a pretty good idea of what we do, because the people who receive it…are living in a house that their grandma owned, they moved in, and dont pay rent, but live there like home owners, only they do not have legal title to the house…

She had a final will made up so that her family would inherit what she left, now before she passed she wrote a letter clarifying that a friend and I be left a certain amount of money. This letter was written after the will, but was notorized and dated and signed like any other document. Is this letter legally binding? Her family is fighting that the letter has no legal standing bc it was not part of the will. Do I have any legal right to what she wrote in the letter that I should receive?
